Affiliate Agreement
APPLICATION
To become an affiliate you must apply and follow all guidelines laid out below in the affiliate agreement. By agreeing to this affiliate agreement you also agree to the website Terms Of Service and Privacy Policy. As an affiliate you agree to be contacted by the email and phone number you provided. Not everyone who applies will become an affiliate and the right to be an affiliate can be revoked by the company at any time.
AFFILIATES
You have the opportunity to become an independent affiliate and earn commissions on the products that you are approved to sell. Each sale is related to your affiliate id. This id is unique to each affiliate and it’s incorporated into your affiliate link. In the event that a customer has more than one affiliate cookie the most recently acquired cookie will determine who is credited with the sale.
COMPENSATION
Affiliates are paid a flat rate commission for each product as follows:
E-book: $2
Physical Book: $7
Digital Book Bundle: $20
Complete Book Bundle: $30
Master Meditation Challenge: $40
Note that the Complete Book Bundle replaces the e-book/physical book in the funnel and no commissions will be paid out for those if the Complete Book Bundle is purchased.
All payouts are in USD and may incur processing fees that will be deducted from your commissions. All payouts will be deposited into your PayPal account on the first of each month.
Affiliates will not be paid any commissions for payments made on their own user accounts.
Justin Wesenberg reserves the sole and exclusive right to determine how much an affiliate is compensated for their efforts.
REFUNDS
Any refunds or chargebacks made by customers you have referred will be deducted from any current or future payouts you are owed. If there are no payouts owed any refunds will be automatically clawed back from your PayPal account or backup accounts.
Customers have up to one year from the date of purchase to refund their purchases.
INDEPENDENT CONTRACTOR
As an affiliate you operate as an independent contractor. This means that you are responsible for paying any taxes, filing any returns, or handling any paperwork that may relate to the income you earn as an affiliate.
ADVERTISING/DISCLOSURE
Affiliates are responsible for following all advertising laws and data protection policies by governing bodies including, but not limited to CAN-SPAM and GDPR.
Affiliates must disclose that they are affiliates earning a commission on the products they are selling and making it clear to their audience.
In addition affiliates must follow all rules on any social media platforms they are using to advertise the products they are promoting.
If affiliates are advertising using unethical or illegal practices this agreement will be terminated immediately and all commissions now and in the future will be forfeited to Justin Wesenberg.
TERMINATION
Justin Wesenberg may terminate this agreement at any time and you as an affiliate can terminate it with 30 days written notice. If we believe that you are violating any terms in this agreement, the website Terms Of Service, or any law we may terminate this agreement and all commissions now and in the future will be forfeited to Justin Wesenberg.
In addition if you have a refund rate or dispute rate greater than 2% we may terminate this agreement at any time without notice to you.
LIMITATION OF LIABILITY
IN NO EVENT SHALL JUSTIN WESESNBERG OR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, INDEPENDENT CONTRACTORS, TELECOMMUNICATIONS PROVIDERS, AND/OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, PUNITIVE, OR ANY OTHER DAMAGES, FEES, COSTS OR CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT, THE PRIVACY POLICY, THE SERVICES OR PRODUCTS, YOUR OR A THIRD PARTY’S USE OR ATTEMPTED USE OF THE WEBSITE OR ANY SOFTWARE, SERVICE, OR PRODUCT, REGARDLESS OF WHETHER JUSTIN WESENBERG HAS HAD NOTICE OF THE POSSIBILITY OF SUCH DAMAGES, FEES, COSTS, OR CLAIMS.
THIS INCLUDES, WITHOUT LIMITATION, ANY LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, COST OF PROCUREMENT OF SUBSTITUTE SERVICES OR PRODUCTS, OR ANY OTHER INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, OR OTHER DAMAGES. THIS APPLIES REGARDLESS OF THE MANNER IN WHICH DAMAGES ARE ALLEGEDLY CAUSED, AND ON ANY THEORY OF LIABILITY, WHETHER FOR BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, OR OTHERWISE.
INDEMNITY
You agree to protect, defend, indemnify and hold harmless Justin Wesenberg, its officers, directors, employees, owner(s) and assigns from and against all claims, demands, and causes of action of every kind and character without limitation arising out of your conduct, acts, or omissions related to your application and/or performance of this Agreement including, but not limited to, any breach of this Agreement.
Your indemnity obligation includes, but is not limited to, any third party claim against Justin Wesenberg for liability or payments for damages caused by, or other liability relating to you. This provision expressly survives the termination of this Agreement.
SEVERABILITY
In the event any provision of this Agreement is inconsistent with or contrary to any applicable law, rule, or regulation, the provision shall be deemed to be modified to the extent required to comply with the law, rule, or regulation, and this Agreement and the Terms of Service, as so modified, shall continue in full force and effect.
